MARENCE has drawn up these Terms to inform you, the Customer who uses or wishes to use our Services and to buy the Products we offer, of the conditions for using our Services.

The Terms set out the conditions on which we maintain and operate the Website, the terms of the distance contract and of delivery, the conditions for buying and returning the Products we offer, and other information about the Services MARENCE provides and the Products it offers.

1. Definitions

Customer(s), you: a person who uses MARENCE Services
Competent Authority: a state or local government authority to which the Customer may apply for the protection of their rights
Contract: a distance contract concluded between MARENCE and the Customer for the purchase of Products and/or a Gift Card

Service(s): any activity carried out by MARENCE in the course of its business, including offering Products and/or Gift Cards to the Customer, performing the Contract, and creating and maintaining a Profile
Personal Data: the Customer’s personal data and other information that is necessary for providing the Services and for other purposes in accordance with the Privacy Policy, and that the Customer has provided to us directly or indirectly
Delivery Provider: a MARENCE partner that delivers the Products you have ordered
Privacy Policy: the Privacy Policy drawn up by MARENCE, which sets out the rules for processing Personal Data
Product(s): the face and body care products and bioactive products made by MARENCE and offered on the Website
Profile: a Customer profile created on the Website
Third Party: any natural or legal person involved in providing a Service to the Customer (for example, postal service providers)

2. MARENCE products

We offer face and body care products and bioactive Products, which you can buy on the Website in the Shop section. You can view the range of Products, with their quantity, weight and size, and order them in the section of the Website for the relevant Product.

Product images on the Website are for illustration only, and the colour shades of the packaging of the Product you receive may differ from those shown on the Website.

The information and content published and available on the Website, including but not limited to the Products and their names, trade marks, logos, graphic marks, images, videos and sound recordings, are the property of MARENCE or our partners and are protected under the laws governing the use of intellectual property, copyright and trade marks. The MARENCE trade mark may not be used without the written permission of MARENCE.

3. Registering on the website

You do not have to create a Customer Profile in order to buy MARENCE Products, but a Profile can make your shopping more convenient and pleasant.

To make it easier to buy the Products and Gift Cards offered by MARENCE on the Website, you can register on the Website, create your Profile and save your delivery address and billing information. The Profile will serve as a channel of communication between you and MARENCE for concluding a distance contract for the purchase of Products in accordance with the Terms and applicable law.

An email address is required to create a Profile, and you will need to set a login password to protect the Profile from unauthorised access. MARENCE reserves the right to block the Profile or deny access to it at any time if it suspects a breach of these Terms or unauthorised access to the Profile. If you suspect that your Profile password has become known to Third Parties, you may change the password or ask us to block access to the Profile and issue a new password. To enable you to exercise these rights, MARENCE may ask you to provide information confirming your identity and that you are the owner of the Profile concerned.

4. Buying products

Products are bought, and the Contract is concluded, through the MARENCE online shop on the Website. Products may not be bought for resale or to pursue any other business interests.

During the ordering process, MARENCE allows you to review and change the Products and/or their quantity, and the amount of the Gift Card, that you wish to buy. Before you place an order, please check the quantity, weight and dimensions of each Product you have chosen, so that your order matches what you want.

You can pay for Products and/or a Gift Card in the following ways:

by payment card;
via PayPal;
by bank transfer.

From the moment you confirm your order by clicking ‘[Confirm purchase / Confirm order]’, you undertake to buy the Products you have chosen and to pay for them and for their delivery.

If you pay by payment card or via PayPal, you will receive confirmation from MARENCE that your order has been received and is being processed, together with an invoice. If you pay by bank transfer, you will receive confirmation from MARENCE that your order has been received. Once you have made the transfer, you will receive confirmation from MARENCE that the purchase has been made and is being processed, and after payment you will also receive confirmation of the invoice.

5. Prices

All Product prices are stated in euros (EUR) and include VAT and/or other applicable taxes and charges. A delivery charge may apply in addition to the Product price shown on the Website.

The delivery charge is calculated on the basis of the delivery address you provide. It is calculated and shown before you confirm and pay for your order. If the delivery charge cannot be calculated precisely before the order is placed, we will let you know.

Payment for Products and delivery can be made on the Website by payment card (MasterCard, Visa, Maestro, Visa Electron), via PayPal or by bank transfer to the MARENCE account number given in the confirmation email that MARENCE sends to your email address after processing the order. The confirmation email is prepared electronically and is valid without a signature.

6. Processing of your personal data

We process your Personal Data so that we can provide our Services, including maintaining your Profile, and can conclude and perform the Contract. Information on how MARENCE processes Customers’ Personal Data is set out in the Privacy Policy.

7. Right of withdrawal

You have the right, within 14 days and without giving any reason, to withdraw from the purchase of the Products you have received. The withdrawal period will expire after 14 days from the day on which we delivered the Product to the delivery address given in the order (if the Products are delivered separately, the period starts on the day on which the last Product is delivered).

You can exercise the right of withdrawal by sending us a notice of your decision to withdraw by letter or by email (MARENCE contact details are given in Clause 9 of the Terms). To meet the withdrawal deadline, it is sufficient for you to send your notice of withdrawal before the withdrawal period has expired.

Please note that you will not be able to exercise the right of withdrawal if you have opened the packaging of a Product that cannot be returned for health and hygiene reasons.

If you withdraw from the purchase, we will refund the payments we have received from you in relation to the Products you have returned. The refund will be made to the bank account from which you paid for the Products, without undue delay and in any event no later than 14 days from the day on which we were informed of your decision to exercise the right of withdrawal.

You must send the Products to the MARENCE address given in Clause 9 of the Terms without undue delay and in any event no later than 14 days from the day on which you informed us of your decision to withdraw. Please note that you will have to bear the direct cost of returning the Products.

MARENCE reserves the right to withhold the refund until we have received the Products back.

The refund will be made using the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise. In any event, you will not be charged any additional fee as a result of the refund.

8. MARENCE rights, liability and other matters

MARENCE reserves the right to stop providing Services to a Customer at any time if it has reasonable grounds to suspect, or has obtained evidence, that the Customer has breached or is breaching the Terms.

MARENCE is not liable for failure to perform the Contract or to provide a Service where this is caused by circumstances and obstacles beyond our reasonable control and by force majeure.

Any disputes, disagreements or misunderstandings relating to the Contract and/or the Services will be resolved by MARENCE and the Customer through negotiation. If such disagreements cannot be resolved through negotiation, you may apply to a court of competent jurisdiction or to a Competent Authority.

We have the right to amend the Terms at any time by publishing the changes on the Website. Any version of the Terms published on the Website replaces all previous versions and takes effect immediately on publication.
